Shanghai Foreign Investment Commission consigns Shanghai Association of Enterprises with Foreign Investment to proceed the review of duty free or non-duty-free importation of new equipment for self use by foreign invested enterprise under the management of Shanghai municipal government, as well as on duty free or non-duty-free importation of second hand equipment for self use by foreign invested enterprise in Shanghai and the duty free importation of equipment for technical upgrading. I. Importation of new equipment for self use Required Documents: 1. Complete truly and correctly the Approval Form of Equipment Importation by Foreign Invested Enterprise in Shanghai in three copies (one to be kept by Shanghai Association of Enterprises with Foreign Investment, the other two to be returned to the enterprise for application to the Customs and for future reference) 2. Certificate of Approval for Establishment of Enterprises with Foreign Investment in P.R. China (Duplicate) 3. Business License with the latest annual joint review on foreign-invested enterprises and stamped with relevant mark by the Industrial and Commercial Dept (Duplicate) 4. The equipment purchasing contract or invoice with the content consistent with the Approval Form (Duplicate is accepted). According to relevant regulations, if the imported equipment is the physical investment from the foreign investor (excluding wholly owned foreign-invested enterprise), or imported equipment purchased by the foreign investor cosigned by the Sino-foreign joint venture or the cooperation company, it should be viewed as the basis for capital verification only after the value assessment on the foreign-invested property by Shanghai Entry-Exit Inspection and Quarantine Association. Therefore the enterprise should complete an additional Approval Form for proceeding relevant procedures. II. Importation of second hand equipment for self use Required documents: Complete truly and correctly the Approval Form of Equipment Importation by Foreign-Invested Enterprise in Shanghai in five copies; Complete truly and correctly the Importation List of Second Hand Mechanical and Electronic Products in five copies; The import of second hand equipment by enterprises approved by the district or county government should be transacted by Shanghai Foreign Investment Commission upon the primary approval of the original examination and approval department. Shanghai Association of Enterprises with Foreign Investment should only review and approve the second hand equipment out of the list of Part II and Part III in the Catalogue II of the Measures for the Administration of Automatic Import Licensing of Goods, No.26 Order of 2004 joint issued by China Commerce Ministry and The Customs General Administration of the People’s Republic of China. The enterprise planning to import the second hand equipment in the above scope should report to Shanghai Import and Export Office of Mechanical and Electronic Products and transfer to the Mechanical and Electronic Products Department under the National Commerce Ministry for examination and approval after being approved by the original reviewing authority. The imported second hand equipment by foreign-invested enterprise should be put on record and required for inspection by Shanghai Entry-Exit Inspection and Quarantine Association. III. Importation of Equipment for Technical Upgrading Foreign-invested enterprises in five categories (state-encouraged category, limited- type B category, advanced technical category, export oriented category, and R&D center category) import self-used equipment, accessories, spares for upgrading the technology, should be approved by Shanghai Association of Enterprises with Foreign Investment firstly, and acquire the Approval Form of Imported Equipment for Technical Upgrading of Foreign Funded Enterprises, by which the enterprises can transact the import reviewing procedures and be issued with the Registration Certificate for Technical Upgrading Project Approval. Note: Limited- type B category has been cancelled according to the regulation of Catalogue for the Guidance of Foreign Investment Industries implemented from April 1, 2002. Required Documents Submission of the Approval of Imported Equipment for Technical Upgrading of Foreign Funded Enterprises; The List of Import Equipment for Technical Upgrading with the company stamp, in two copies (the List should indicate the name of import equipment, accessories, spares name, specification, quantity, value, total price (in USD), Import Taxation Number, contact person and telephone.) The proceed date and total amount of each batch of imported equipment, accessories and spares should be within the validity and foreign fund amount ratified by the Approval of Imported Equipment for Technical Upgrading of Foreign Funded Enterprises. Equipment, accessories and spares for import should not be commodities listed in the Catalogue of Non-Duty-Free Commodities to be Imported for Domestic-funded Projects IV.
