I. Confirmation of advanced technology enterprises with foreign investment

Materials needed:

1 Requirement for applying for “advanced technology enterprise”

The foreign funded enterprises could be confirmed as “advanced technology enterprise” provided meeting following requirements:

1.1 Production oriented enterprise or enterprise engaged in R&D;

1.2 Use the international advanced or suitable technology, technique and equipment;

1.3 Product quality and technology performance meeting the national leading level or international advanced level;

1.4 The enterprise has been put into production for over 6 months.

This enterprise couldn’t be confirmed as “advanced technology enterprise” in case it only tops others in terms of equipment performance and efficiency compared with that of the domestic equipment, or mainly engages in imported part assembling project.

2. Documents to be submitted for application for confirmation of “advanced technology enterprise”

2.1 Application for confirmation and examination table for “advanced technology enterprise”;

2.2 Written application of the enterprise;

2.3 Approval certificate, business license, feasibility study report, contract (inclusive of technology transfer contract or agreement), articles of association and other approval documents (copies);

2.4 Capital verification report on the contribution of the registered capital of the investors issued by certified public accountant;

2.5 Other certificate material and enterprise honorary certificate of relevant technology

3. Process for confirmation of “advanced technology enterprise” through application

3.1 With the opinion executed by the competent foreign trade and economic committee at district and county levels (or Association of Enterprises with Foreign Investment), the written application and documents attached by the enterprise will be submitted to Shanghai Association of Enterprises with Foreign Investment;

3.2 The units directly under the government of the city submit the application to Association of Enterprises with Foreign Investment;

3.3 Shanghai Association of Enterprises with Foreign Investment organizes industrial experts to conduct technology appraisal of the units applying for the title of “advanced technology enterprise”, and makes technology appraisal conclusion;

3.4 Shanghai Association of Enterprises with Foreign Investment provides opinion on preliminary examination, and reports it to Shanghai Economic Relation & Trade Commission for confirmation;

 3.5 Shanghai Association of Enterprises with Foreign Investment will issue confirmation letter and stainless steel title for “advanced technology enterprise”.

II. Confirmation of foreign funded exporter

Materials needed:

1. Requirements for application of confirmation of “exporter”

The foreign funded enterprise could be confirmed as “exporter” provided meeting following requirements:

1.1 The enterprise produces products for exportation;

1.2 Annual export amount (inclusive of self exportation, exportation by foreign trade company as an agent and other exportation means) accounts for over 50% of the sales of all the products;

1.3 Surplus or balance between income and expenditure of the foreign exchange in the current year (the foreign exchange income is more than the foreign exchange expenditure in that year, exclusive of the balance of the carrying-forward of the previous year);

1.4 The operation of the enterprise should fulfill one year at least and realize profit in that year.

2. Documents required for the confirmation of “exporter”

2.1 Application for confirmation & approval and examination table of “exporter”

2.2 Approval certificate, business license, contract, articles of association and approval document (copies) of the enterprise (copies);

2.3 Capital verification report of the registered capital contribution of the investors issued by CPA;

2.4 Audit report of the previous year issued by CPA;

2.5 Other certificates (e.g. certificates of exportation by foreign trade companies as agent, etc)

3. Process for the application for confirmation of “exporter”

3.1 The enterprise submits the written application and documents needed to the relevant foreign economic relation commissions of district and county levels (or Association of Enterprises with Foreign Investment) and authorities; and upon the execution of opinions by them, submits the application and documents to Association of Enterprises with Foreign Investment;

3.2 The unit directly under the government of the city submits the application to Association of Enterprises with Foreign Investment;

3.3 Association of Enterprise with Foreign Investment of Shanghai summarizes the materials related with application for “exporter”, brings forward preliminary examination opinion, and reports them to Shanghai Economic Relation and Trade Commission for confirmation;

3.4 Confirmation certificate of “exporter” issued by Association of Enterprises with Foreign Investment as an agent.
