Submitting and Examination for Exporting Quota Licensed Products

1. Verification of Export Scale of Licensed Products

For products required export license, enterprises should submit the following documents to Shanghai Foreign Economic Relation & Trade Commission, which will be submitted to Ministry of Commerce after the first approval, then enterprises can apply for export licenses with the approval reply of MOC:

1) Applications for the establishment of enterprises;

2) Proposals of projects or feasibility reports.

After the establishment of enterprises, for approved quota-free licensed products incorporated into the range of quota products with export licenses, enterprises can apply to Shanghai Foreign Economic Relation & Trade Commission for the verification of export scale; after the first approval, the application will be submitted to Ministry of Commerce for examination and approval. Finally, enterprises can apply for the verification of export scale with the approval reply of MOC. Following documents will be required:

1) Applications for export quota and licenses (original copy);

2) The duplicated version of approval documents for the establishment of enterprises;

3) Feasibility reports and the duplicated version of contracts of joint operation as well as articles of association;

4) The duplicated version of certificates of approval and business licenses;

5) Reports on the verification of capital

6) Financial audit reports.

        

2. Declaration of Yearly Export Plans Related to Licensed Products

Required documents:

1) Before October every year, if enterprises have got the approval of MOC for export scale of listened products, they can declare their export plans of the next year to Shanghai Foreign Economic Relation & Trade Commission with following documents:

a) Applications;

b) The approval reply of MOC for export scale.

2) Submit to MOC after examining and summarizing by Shanghai Foreign Economic Relation & Trade Commission.

Shanghai Foreign Economic Relation & Trade Commission notifies export plans issued by MOC to applying enterprises.

Enterprises apply for export licenses with the “notice”.

 

3. Applying for Exporting Precursor Chemicals

Required documents:

After getting the approval reply of MOC for export scale, enterprises file an application for export quota and licenses, which will be submitted to MOC by examining and approving organs. Required documents are as follows:

1) Applications for importing precursor chemicals (original copy);

2) Valid import contracts signed with foreign clients (original copy);

3) Documents of approval, certificates of approval and business licenses, as well as contracts for joint operation, articles of association and reports of capital verification;

4) For exporting controlled products, enterprises should provide legal and valid import licenses (generally, they should be the original copy; for European countries, duplicates can be accepted; and for the USA, approval letters issued by DEA will be required) issued by importing countries or administrative departments of regional governments; if products must be exported through the third country or region, besides the above-mentioned documents, enterprises should provide valid entrepot certificates issued by administrative apartments of the third country or region.
